STANDARDIZED OPERATING PROCEDURES FOR PROSPECTIVE HOME BUYERS IN NEW YORK STATE PURSUANT TO NEW YORK REAL PROPERTY LAW SECTION 442-H
The Standardized Operating Procedures (“SOPs”) of LHWS LLC (“Broker”) setting forth the prerequisites for prospective home buyers in New
York State prior to receiving services from Broker and its salespersons are as follows:
1- Personal Identification. Prospective home buyers are not required to provide personal identification prior to receiving services from Broker and its salespersons.*
2- Exclusive Broker Agreements. Prospective home buyers are not required to sign an exclusive broker agreement with Broker prior to receiving services from Broker and its salespersons, but such an agreement may be requested and used if both Broker (or its salesperson) and the prospective home buyer agree.
3- Mortgage Pre-Approval. Prospective home buyers are not required to obtain and provide a mortgage pre-approval prior to receiving services from Broker and its salespersons.*
*Regardless of Broker’s Standardized Operating Procedures, a seller/homeowner, listing broker/agent or other applicable third party may require personal identification or mortgage pre-approval from a prospective home buyer prior to showing a property, providing access to an open house and/or receiving an offer to purchase.
The above SOPs are effective as of April 20, 2022.
